Chief
Justice Roy Moore is Removed from
Office
November
13, 2003
Mathew D. Staver
Today,
a nine-member panel of the Alabama
Court of the Judiciary voted
unanimously to remove Justice Roy
Moore from his office as Chief Justice
of the Alabama Supreme Court. The
essence of the Order is that a judge
must obey a court order after
exhausting all legal remedies, and if
there is a conflict between a state
and the federal constitution, the
federal constitution prevails.
It
is unclear from this Order whether
Justice Moore may remain a judge on
the Alabama Supreme Court. However,
since the Chief Justice position is an
elected office, the probable outcome
is that this decision completely
removes him from the bench. To read

not address the Ten Commandments
issue, it only addressed the Alabama
canons of judicial ethics.

separate Ten Commandments cases around
the country and has successfully
defended the display of the Ten
Commandments as stand-alone monuments
or within the context of other
historical and legal documents. For

UPDATE
ON CHRISTIAN AND POLITICAL FLOATS
Last
week I informed you
about the victory involving the
homecoming floats of the Fellowship of
Christian Athletes and Young
Republicans. After these students
stood up against the attempted
censorship and Liberty Counsel began
preparing a federal lawsuit, the
school backed down. Not only were the
floats featured twice in the Orlando
Sentinel newspaper and on all the
local media, the FCA float took the
"Most Spirited" award and
the Young Republicans won the
"Most Creative" award. These
awards were voted on by their
classmates.
